    Please read these General Terms and Conditions and the Disclaimer carefully before using the content of this website or purchasing our online courses. By using this website and purchasing our courses, you agree to all of the following terms.


    § 1 – Scope and Contracting Parties

    § 1.1 – Scope

    These General Terms and Conditions (hereinafter "GTC") apply to all contracts between

    and the buyer (hereinafter "Customer") for the purchase of digital online courses via the website tcmdocuy.com.

    Deviating terms of the Customer shall not apply unless the Provider has expressly agreed to them in writing.

    § 1.2 – Conclusion of Contract

    The contract is concluded as follows:

    • The Customer selects an online course and clicks the purchase button — this constitutes a binding purchase offer by the Customer.
    • The contract is deemed effectively concluded as soon as the Provider sends a purchase confirmation email to the specified email address or activates access to the course — whichever occurs first.
    • The Provider is entitled to reject a purchase offer without stating reasons.

    The contract language is German. The contract text is not stored by the Provider and is no longer accessible after conclusion of the contract. The Customer is therefore recommended to save the order confirmation.

    § 1.3 – Prices and Payment

    All stated prices are final prices in euros (€). As the Provider operates as a physician under the small business regulation, no VAT is shown (pursuant to § 6 para. 1 no. 27 UStG).

    • Payment is made immediately upon completion of the purchase via the available payment methods (credit card, PayPal).
    • The purchase price is due immediately upon ordering.
    • The Provider reserves the right to change prices at any time. For already completed purchases, only the price valid at the time of purchase applies.

    Payment processing is handled by the payment service provider systeme.io as well as Stripe and PayPal. The privacy policies of these providers apply additionally.

    § 1.4 – Service Description and Access

    After successful completion of the purchase, the Customer receives immediate digital access to the purchased course content via the systeme.io platform.

    • Course content includes instructional videos, texts, graphics, and infographics in German.
    • Access is unlimited in time (lifetime), provided the platform is technically available.
    • The Provider reserves the right to update, expand, or correct course content — for the benefit of the Customer.
    • A complete permanent removal of course content will be announced to the Customer at least 30 days in advance by email.

    § 2 – Medical Disclaimer

    § 2.1 – No Medical Advice or Treatment

    The content of this website and our online courses is for general information and educational purposes only.

    The information, techniques, videos, and course content provided do NOT constitute medical advice, diagnosis, or treatment and in no way replace personal consultation, examination, or treatment by a qualified physician or healthcare practitioner.

    IMPORTANT: All information on this website and in our courses is general in nature and not tailored to your individual health situation. You should never ignore or delay medical advice based on information on this website or in our courses.

    § 2.2 – No Substitute for Professional Medical Care

    The online courses on Traditional Chinese Medicine (TCM) and acupressure offered on this website are educational offerings for self-help and do NOT replace:

    • Diagnosis by a physician
    • Medical treatment
    • Prescription of medications
    • Emergency medical care
    • Treatment of serious or chronic conditions
    • Psychotherapeutic or psychiatric treatment

    § 2.3 – Consultation Requirement

    Before applying any of the techniques shown in our courses, you must consult a qualified physician, especially if:

    • You suffer from a chronic condition (e.g., diabetes, cardiovascular disease, cancer, autoimmune diseases)
    • You take prescription medications
    • You are undergoing medical treatment
    • You suffer from acute pain or discomfort

    • You have blood clotting disorders
    • You have a history of thrombosis
    • You suffer from epilepsy
    • You have implants (e.g., pacemaker)
    • For children or elderly persons with pre-existing conditions

    You act at your own risk if you apply the learned techniques without prior medical consultation.


    § 3 – No Doctor-Patient Relationship

    § 3.1 – Educational Offering, Not Treatment

    The purchase and use of our online courses does NOT establish a doctor-patient relationship.

    Dr. med. José Uy provides through the online courses:

    • ❌ NO individual treatment
    • ❌ NO personal medical advice
    • ❌ NO therapy recommendations for your specific case
    • ✅ ONLY general educational content for knowledge transfer

    § 3.2 – Personal Treatment Only at Practices

    A personal doctor-patient relationship exists exclusively when you visit Dr. med. José Uy in person at one of his practices in Henndorf am Wallersee or Salzburg and receive treatment there.

    § 3.3 – No Individual Consultation Through Online Courses

    The online courses do not offer any opportunity for individual communication, diagnosis, or treatment recommendations. They are standardized educational content created for a general audience.

    For individual medical questions or treatments, please contact one of the practices by phone or email to arrange a personal appointment.


    § 4 – Application at Your Own Responsibility and Risk

    § 4.1 – Personal Responsibility

    You apply all techniques, exercises, and methods shown in the courses exclusively at your own responsibility and risk.

    By participating in our courses and applying the taught techniques, you agree that:

    • You bear full responsibility for your health and well-being
    • You independently decide whether and how to apply the techniques
    • You inform yourself about possible risks and contraindications before applying the techniques
    • You will immediately consult a doctor if you have uncertainties or complaints

    § 4.2 – Possible Risks

    The application of acupressure and TCM techniques may in rare cases lead to undesirable reactions, including:

    • Temporary worsening of symptoms
    • Fatigue or energy loss
    • Emotional reactions
    • Skin irritation at pressure points
    • Dizziness or discomfort
    • In case of incorrect application: pain or injury

    If side effects occur or your condition worsens, stop the application immediately and consult a doctor.

    § 4.3 – Contraindications

    Do NOT apply the taught techniques if:

    • You have acute inflammations or infections
    • You have open wounds, skin diseases, or eczema in the treatment area
    • You suffer from acute pain of unclear cause
    • You have a fever
    • You are in an acute stage of illness
    • Your doctor advises against application
    • You have severe cardiovascular diseases
    • You suffer from acute psychiatric symptoms
    • You have recently had a stroke or heart attack

    If in doubt, always consult a doctor first!


    § 5 – Emergency Situations

    § 5.1 – Not for Medical Emergencies

    This website and our online courses are NOT intended for medical emergencies. The taught techniques can be supportive but are NOT a substitute for emergency medicine.

    § 5.2 – Call Emergency Services Immediately

    In medical emergencies, call immediately:

    § 6.1 – Individual Results

    This website may present experience reports, testimonials, and success stories from patients who were personally treated at Dr. med. José Uy's practices.

    IMPORTANT NOTE: These experience reports represent individual experiences and results that are not typical and cannot be guaranteed. The results shown are individual cases and cannot be transferred to other persons.

    § 6.2 – No Guarantee of Healing Success

    Expressly NO guarantee or assurance is given that:

    • You will achieve similar or comparable results
    • A specific improvement in your health will occur
    • Healing or relief of your symptoms will occur
    • The techniques will be effective for you

    § 6.3 – Testimonials from Practice Patients

    The testimonials shown come from patients who were personally treated at the practices and received an individual diagnosis and tailored treatment there. These results CANNOT be equated with the online courses, as the online courses are general educational content and no individual treatment by Dr. Uy takes place.

    In accordance with Austrian and EU consumer protection law: "The experience reports presented are genuine experiences of individual persons. However, these results are not typical and cannot be understood as a guarantee for future results. Individual results may vary significantly."

    § 7 – No Result Guarantees

    § 7.1 – Educational Content Without Success Promises

    Expressly NO guarantee or assurance is given for:

    • ❌ The effectiveness of the techniques for you personally
    • ❌ An improvement or healing of your complaints
    • ❌ Specific health outcomes
    • ❌ A specific timeframe for improvement
    • ❌ Avoidance of side effects
    • ❌ Suitability for your specific situation

    § 7.2 – No Healing Promises

    Dr. med. José Uy makes no healing promises through the online courses. The courses serve to impart knowledge about traditional Chinese medicine practices. The effectiveness of TCM techniques varies individually and is not conclusively scientifically proven for all areas of application.


    § 8 – Scientific Basis and Traditional Medicine

    § 8.1 – Traditional Chinese Medicine

    The content taught in the courses is based on the principles of Traditional Chinese Medicine (TCM), which has developed over millennia in China and is based on a different medical paradigm than Western conventional medicine.

    § 8.2 – Scientific Evidence Status

    While many TCM methods have been traditionally applied for centuries and some scientific studies provide positive indications, not all TCM practices are fully scientifically proven or recognized according to the standards of evidence-based Western medicine.

    § 8.3 – Complementary Application

    TCM techniques should be understood as complementary (supplementary) to conventional medical care and should not replace it.


    § 9 – Limitation of Liability

    § 9.1 – Exclusion of Liability

    Dr. med. José Uy, the website tcmdocuy.com, and all persons associated with this website assume NO liability for:

    • Direct or indirect damages arising from the use of this website or the online courses
    • Health damages or deterioration resulting from the application of the taught techniques
    • Decisions you make based on information on this website
    • Errors, incompleteness, or inaccuracies in the content
    • Technical problems or failures of the website or course platform
    • Loss of data or access to course content
    • Lost profits or other economic damages
    • Consequential damages of any kind

    § 9.2 – Liability Only for Intent or Gross Negligence

    The liability of Dr. med. José Uy is limited to intent and gross negligence under Austrian law. Liability for slight negligence is excluded to the extent permitted by law (§ 6 para. 1 no. 9 KSchG remains unaffected).

    § 9.3 – No Liability for Third-Party Content

    This website may contain links to external third-party websites (e.g., YouTube). We assume no responsibility or liability for the content of these external sites.


    § 10 – Return and Refund Policy

    § 10.1 – No Refund for Digital Products

    For all online courses: After purchase and immediate access to the digital content, the statutory right of withdrawal pursuant to § 18 para. 1 no. 11 FAGG does not apply and no refund of the purchase price will be made.

    § 10.2 – Legal Basis (EU Consumer Law)

    Pursuant to Article 16 of the EU Consumer Rights Directive (2011/83/EU) and § 18 para. 1 no. 11 of the Austrian Distance and Off-Premises Contracts Act (FAGG), the right of withdrawal does not apply to:

    "the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and acknowledgment that he thereby loses his right of withdrawal."

    § 10.3 – Declaration of Consent at Purchase

    By purchasing an online course, you expressly agree that:

    • ✅ You receive immediate access to the digital course content
    • ✅ Service provision begins immediately after purchase
    • ✅ The statutory right of withdrawal pursuant to § 18 FAGG does not apply
    • ✅ No refund of the purchase price will be made

    This declaration of consent is displayed to you before completing the purchase on the checkout page and must be actively confirmed.

    § 10.4 – Exception for Technical Defects

    Notwithstanding the foregoing, in the event of material technical defects (e.g., permanently unavailable videos, permanently faulty access), the Customer is entitled to rectification by the Provider pursuant to §§ 922 ff. ABGB. If the defect cannot be remedied within 14 days, the Customer is entitled to a proportional refund or free replacement access. Abusive or pretextual defect claims will be disregarded.

    § 11 – Target Audience and Terms of Use

    The Customer undertakes to:

    • Inform the Provider immediately if login credentials have fallen into unauthorized hands
    • Not use any technical measures to circumvent access restrictions or copy protection
    • Not create or distribute screenshots, screen recordings, or recordings of course content

    § 11.3 – Age Requirement

    Use of the courses is permitted from 16 years of age. Persons under 16 require the express consent of their legal guardians. By purchasing, the Customer confirms having reached the required minimum age.

    § 11.4 – Geographic Availability

    The courses are available worldwide. The course content is created in German and is primarily aimed at German-speaking users in Germany, Austria, and Switzerland. For international users, different local legal provisions may apply — the Provider assumes no responsibility for this.


    § 12 – Video Demonstrations and Instructions

    § 12.1 – Demonstration Purposes

    All video demonstrations and instructions shown in the courses are exclusively for educational and demonstration purposes. The videos show general techniques and are not tailored to your individual situation.

    § 12.2 – Application at Your Own Responsibility

    If you apply the techniques demonstrated in videos at home:

    • ⚠️ You act at your own risk
    • ⚠️ Start carefully and with gentle pressure
    • ⚠️ Stop application immediately if you experience pain or discomfort
    • ⚠️ Consult a doctor or qualified TCM therapist if uncertain
    • ⚠️ Never practice on other persons without appropriate professional training

    § 12.3 – No Authorization for Treating Third Parties

    The courses do NOT authorize or qualify you:

    • ❌ For professional treatment of patients
    • ❌ For practicing a healthcare profession
    • ❌ For conducting diagnoses
    • ❌ For commercial application of TCM techniques on third parties

    The courses are exclusively for self-application or for personal continuing education of already qualified medical professionals.


    § 13 – Intellectual Property and Copyright

    § 13.1 – Copyright Protection

    All content of this website and the online courses (including texts, images, videos, graphics, logos, audio files) is protected by copyright and is the property of Dr. med. José Uy or is used with appropriate license.

    § 13.2 – Usage Rights

    By purchasing an online course, you acquire a personal, non-transferable, non-exclusive right of use for the course content exclusively for your private, personal use.

    Prohibited in particular are:

    • ❌ Making content publicly available or publishing it
    • ❌ Commercial use of the content
    • ❌ Copying, duplicating, or distributing the content
    • ❌ Editing or modifying the content

    Copyright violations will be prosecuted.


    § 14 – Data Protection

    § 15 – Changes to These GTC

    The Provider reserves the right to change or update these GTC at any time. Changes will be published on this page and take effect 30 days after announcement.

    Material changes will be communicated to the Customer at least 30 days before taking effect by email to the address provided during registration. If the Customer does not object within 30 days of receiving the notification, the amended GTC shall be deemed accepted. This right of objection and the consequences of silence will be expressly stated in the change notification.

    Continued use of the website and courses after publication of changes constitutes acceptance of the changed terms. Please check these GTC regularly for updates.


    § 16 – Severability Clause

    Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. In place of the invalid or unenforceable provision, a valid provision shall apply that comes closest to the economic purpose of the invalid or unenforceable provision. The same applies to any regulatory gaps.


    § 17 – Applicable Law and Jurisdiction

    Austrian law applies to all legal relationships between Dr. med. José Uy and users of this website, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

    The place of jurisdiction for all disputes is, to the extent legally permissible, the registered office of Dr. med. José Uy in Henndorf am Wallersee, Austria.

    For consumers, the statutory provisions on jurisdiction pursuant to § 14 KSchG apply (domicile or habitual residence of the consumer in Austria).

    For consumers within the EU: The European Commission provides an online platform for alternative dispute resolution at ec.europa.eu/consumers/odr. The Provider is not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
